ISEA SMS/MMS Messaging Terms and Conditions

1. Scope

These SMS/MMS Messaging Terms and Conditions (“Messaging Terms”) govern text messages sent by or on behalf of the Iowa State Education Association (“ISEA,” “we,” “us,” or “our”) through telephone numbers and messaging services controlled by ISEA.

These Messaging Terms supplement ISEA’s Privacy Policy and any other terms applicable to ISEA websites, member portals, programs, or services. They do not govern messages sent independently by the National Education Association, NEA Member Benefits, a local affiliate, a candidate committee, a political action committee, or another organization unless the applicable enrollment disclosure expressly states otherwise.

2. Types of messages

Depending on the program for which you enroll, ISEA messages may include:

  • Responses to questions or requests you initiate. 
  • Membership, account, security, or service-related information. 
  • Meeting, event, conference, training, course, or appointment reminders. 
  • Member-benefit and professional-development information. 
  • Organizational announcements, news, surveys, and calls for feedback. 
  • Legislative updates and issue-advocacy or action alerts. 
  • Other messages specifically described when you opt in. 

Fundraising, political action committee solicitations, and candidate endorsements are outside of the scope of ISEA’s intended use of SMS/MMS communication.

3. Consent to receive messages

You may enroll by taking an affirmative action described by ISEA, such as checking an optional checkbox, providing your mobile telephone number and acknowledging it will be used for automated calling techniques and/or text messaging, signing a form, submitting an online form, texting an advertised keyword or number, or making another clear request to receive messages.

By enrolling, you authorize ISEA to send recurring SMS or MMS messages to the mobile telephone number you provide. Messages may be sent through an automated telephone dialing or messaging system. 

Consent to receive text messages is voluntary and is not a condition of ISEA membership, employment, representation, access to member benefits or services, participation in an event, or the purchase of any product or service.

You may choose not to receive text messages and continue to communicate with ISEA through other available methods.

4. Message frequency and charges

Message frequency varies by program and activity. Frequency may increase during legislative sessions, elections, conferences, meetings, urgent organizational developments, or other periods relevant to the program for which you enrolled.

ISEA does not charge a separate fee for its text-message programs. Message and data rates imposed by your wireless carrier may apply. ISEA and local and national affiliates will never charge for text message alerts.

5. How to opt out

You may opt out of a messaging program at any time by replying STOP to an ISEA text message.

You may also opt out by submitting a written email request to opt out of text messaging to [email protected]. 

After an opt-out request, ISEA may send one final, nonpromotional message confirming the request. ISEA will process automated STOP requests promptly and will honor all opt-out requests within the time required by law. 

Opting out of text messages does not cancel your ISEA membership, employment relationship, representation, benefits, registrations, or other services.

6. Help and customer care

For assistance:

When contacting ISEA, include the mobile number receiving messages and a brief description of the issue. Do not send sensitive personal, financial, health, or account information by ordinary text message.

7. Privacy and use of mobile information

ISEA may collect and maintain information associated with the messaging program, including:

  • Your mobile telephone number. 
  • Your enrollment and consent records. 
  • The date, time, source, and language of your consent. 
  • Message content and responses. 
  • Delivery, error, and opt-out records. 
  • Carrier and device-related information provided through the messaging service. 

ISEA may use this information to:

  • Operate and administer its text-messaging programs. 
  • Provide requested information, services, reminders, and communications. 
  • Respond to questions or requests. 
  • Document consent and opt-out activity. 
  • Maintain suppression and do-not-contact records. 
  • Protect ISEA systems, information, members, employees, and other users. 
  • Comply with applicable law, legal process, and carrier requirements. 
  • Evaluate and improve ISEA communications.

ISEA does not sell, rent, or share mobile telephone information, including mobile opt-in or consent information, with unaffiliated third parties for their independent marketing or promotional purposes. 

ISEA may disclose this information to third-party service providers solely to operate, maintain, secure, and support ISEA’s messaging programs. Such service providers are not permitted to use mobile messaging information for their own marketing or promotional purposes. 

As a state education association affiliated with the National Education Association, NEA Member Benefits, and our statewide local associations, ISEA may share personal information, including contact information and mobile telephone numbers, with those organizations for membership administration and member-related representation, benefits, education, research, advocacy, organizing, and other activities consistent with our organizational purposes. 

ISEA may also disclose information when required by law, when reasonably necessary to protect legal rights, safety, or security, or at the direction of the affected individual.

ISEA will require its messaging-service providers to use mobile-messaging information only for the services they provide to ISEA and not for their own marketing or promotional purposes.

ISEA uses reasonable administrative, technical, and physical measures intended to protect mobile-messaging information. However, ordinary SMS and MMS communications are not completely secure, and recipients should not send confidential legal, financial, medical, employment, or other sensitive information by text message.

8. Telephone-number reassignment

Mobile telephone numbers may be reassigned. Before discontinuing or transferring a telephone number enrolled in an ISEA messaging program, you agree to opt out or notify ISEA.

ISEA may use reasonable methods to identify deactivated or reassigned numbers and may suspend messaging when it has reason to believe that the intended recipient no longer controls a number.

9. Availability and delivery

Messaging services are provided on an “as available” basis and may not be available through every carrier, telephone number, device, or geographic area. Wireless carriers are not responsible for delayed or undelivered messages.

Delivery may be affected by carrier filtering, network availability, device settings, system maintenance, emergencies, or circumstances outside ISEA’s control. ISEA does not guarantee that every message will be delivered or received within a particular time.

10. Replies are not necessarily confidential

Text-message replies may be received or processed by ISEA employees, contractors, and messaging-service providers. Ordinary SMS and MMS are not secure communication methods and should not be used to transmit confidential legal, employment, financial, medical, or personally sensitive information.

ISEA may retain messages and related records in accordance with its record-retention, legal, security, and operational requirements.

11. No emergencies or deadline-sensitive submissions

ISEA text-message programs are not emergency-response services. Do not use text messaging to report an emergency or an immediate threat to health or safety.

Unless ISEA has expressly authorized a particular texting procedure in writing, a text message does not constitute formal submission of:

  • A grievance, complaint, appeal, claim, or legal notice. 
  • A request intended to satisfy a contractual or statutory deadline. 
  • A document requiring a signature or formal filing. 
  • A request for immediate legal representation or emergency assistance. 

Use the applicable formal procedure or contact ISEA directly for deadline-sensitive matters.

12. Suspension or termination

ISEA may suspend or terminate a messaging program, a particular telephone number, or an individual’s participation when reasonably necessary for operational, legal, security, carrier-compliance, or misuse-related reasons.

ISEA may also discontinue a program without liability, subject to applicable law and any separate obligations governing the underlying service.

13. Changes to these Messaging Terms

ISEA may update these Messaging Terms to reflect changes in its programs, technology, vendors, carrier requirements, or applicable law. The current version will be posted on ISEA’s website with a revised “Last updated” date.

When required by law, ISEA will provide additional notice or obtain new consent before using an existing consent for materially different message types or programs.

15. Governing law

These Messaging Terms are governed by applicable federal law and the laws of the State of Iowa, without limiting any rights that cannot lawfully be waived.
