ISEA Website Terms of Use

1. Accepting These Terms
These Terms of Use (“Terms”) apply to www.isea.org and www.iseahub.org (together, the “Site”). The Iowa State Education Association (“ISEA,” “we,” or “us”) makes the Site available on the conditions in these Terms, which cover every feature of the Site unless we say otherwise.
By using the Site, you accept these Terms. If you do not agree to them, you may not use the Site.
We may change these Terms at any time by posting the updated version on this page and changing the “Last updated” date at the end. If you keep using the Site after we post changes, you accept the updated Terms.
 

2. About the Site
ISEA is the Iowa state affiliate of the National Education Association (“NEA”). Through the Site, ISEA offers its members and other supporters of public education information, resources, and tools. We may change, suspend, or discontinue all or part of the Site at any time, for any reason, without notice, and we are not liable to you for doing so.
Information on the Site is general and is not legal advice, and using the Site does not create an attorney-client relationship. Members with a workplace concern should contact their local association leaders or their ISEA UniServ Director.


3. Registration
If you register for an account, you agree that the information you give us will be truthful, accurate, and current, and that you will update it when it changes. Member accounts are available only to current ISEA members who verify their membership.
 

4. Privacy
Our Privacy Policy governs the registration details and other personal information you give us through the Site.
 

5. Password and Account Security
Keep your username and password confidential. You are solely responsible for everything done with your password.
Member-only content is for ISEA members and may include confidential Association information, such as bargaining or organizing plans. Do not share it, or your access to it, with anyone who is not an ISEA member unless ISEA has authorized it.
 

6. Rules of Conduct
As a condition of using the Site, you agree not to use it to:
1.    pretend to be someone else, including an official of ISEA, NEA, or a local association, or misrepresent your connection to any person or organization;
2.    hide the source of anything you send through the Site, such as by forging headers or altering identifiers;
3.    harm minors in any way, including by sharing content that identifies a student without every permission required by law and school district policy;
4.    harass, threaten, or embarrass anyone, or cause anyone distress, discomfort, or unwanted attention;
5.    share anything unlawful, abusive, defamatory, vulgar, obscene, hateful, or discriminatory, or anything else ISEA finds objectionable;
6.    share anything that infringes someone else's copyright, trademark, patent, trade secret, or other rights;
7.    send spam, bulk email, unsolicited advertising, or other solicitations;
8.    upload viruses or other code meant to disrupt, damage, or limit any software, hardware, or telecommunications equipment;
9.    interfere with the Site or the servers and networks connected to it, or ignore those networks' requirements or policies;
10.    collect or use information about ISEA members or other users for any purpose ISEA has not authorized;
11.    use bots, scrapers, or other automated tools to copy or collect Site content or data, including to train artificial intelligence models, without ISEA's written permission; or
12.    break any local, state, national, or international law, whether on purpose or not.
This list gives examples and is not complete. ISEA decides, in its sole judgment, whether conduct breaks these rules.
 

7. Content You Submit
“Content” means text, photos, video, audio, graphics, software, and other material. When you submit Content to ISEA, whether for the Site, an email list, a discussion board, or anything else, you promise that:
•    you own or control all rights to it;
•    our publishing it will not infringe anyone's copyright, trademark, patent, trade secret, or other rights; and
•    you have followed these Terms.
You also give ISEA and its local affiliates (together, the “ISEA Parties”) a worldwide, royalty-free, nonexclusive, perpetual, irrevocable, and fully sublicensable right to use, copy, edit, publish, translate, adapt, distribute, and display your Content in any medium. The ISEA Parties may also use the name and contact information you submit with it. You will not be paid for your Content unless a signed written agreement says so.
 

8. Indemnification
You agree to indemnify and hold harmless the ISEA Parties, and each of their officers, directors, employees, agents, and partners, against any third-party claim or demand, including attorneys' fees, that arises from:
•    Content you share through the Site;
•    your use of the Site;
•    your connection to the Site; or
•    your violation of these Terms.
 

9. Termination
ISEA may end your use of the Site at its sole discretion, for any reason, including a violation of these Terms, and without notice. ISEA is not liable to you for ending your access.
Losing access to the Site does not by itself end your ISEA membership, which is governed by the documents described in Section 18.
 

10. Advertisers and Sponsors
ISEA may sell advertising or sponsorships on the Site to help cover its costs. We do not review or evaluate advertisers' products, services, or offers, so we make no promises about them.
Any communication or transaction with an advertiser is solely between you and that advertiser. ISEA is not liable for any loss or damage that results.
 

11. Third-Party Content and Services
To offer a wide range of resources, the Site includes content and services from third parties, such as course providers, payment processors, and member benefit programs. Those belong to the third parties that provide them, not to ISEA. ISEA does not endorse them and is not responsible for whether they are accurate or reliable.
Payments on the Site are handled by third-party payment processors. When you pay, you confirm that you are authorized to use the payment method, and refunds follow the terms shown when you buy or register.
 

12. Links to Other Sites
These Terms do not apply to websites linked from the Site, including NEA's website (nea.org). Linked sites have their own policies and practices, which may differ from ours.
ISEA does not operate, endorse, or take responsibility for linked sites or their content, services, or advertising. ISEA is not liable for any loss or damage they cause.
 

13. Disclaimer of Warranties
YOU AGREE THAT YOU USE THE SITE AT YOUR OWN RISK. THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND ISEA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
ISEA ALSO DOES NOT WARRANT THAT:
•    THE SITE'S CONTENT IS ACCURATE OR RELIABLE;
•    THE SITE WILL BE AVAILABLE AT ANY GIVEN TIME OR PLACE;
•    PRODUCTS, SERVICES, INFORMATION, OR MATERIALS YOU OBTAIN THROUGH THE SITE WILL MEET YOUR EXPECTATIONS;
•    SOFTWARE DEFECTS OR ERRORS WILL BE FIXED; OR
•    THE SITE'S CONTENT IS FREE OF VIRUSES OR OTHER HARMFUL CODE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTIES TO BE EXCLUDED, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
 

14. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AGREE THAT THE ISEA, NEA, NEA MEMBER BENEFITS, AND EACH ENTITY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE, THAT RESULT FROM YOUR USE OF, OR INABILITY TO USE, THE SITE. THIS APPLIES EVEN IF ISEA WAS TOLD SUCH DAMAGES WERE POSSIBLE, AND WHETHER THE CLAIM RESTS ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN DAMAGES TO BE EXCLUDED OR LIMITED, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.
Nothing in these Terms limits any right a member has, or any duty ISEA owes its members, under law or ISEA's governing documents, including duties related to representation.
 

15. Intellectual Property
Unless stated otherwise, Content on the Site belongs to the ISEA Parties, NEA, third-party providers, or their licensors, and it is protected by copyright, trademark, and other laws. You may view and display it only for your own personal, non-commercial use. You may not copy, modify, publish, translate, adapt, distribute, display, retransmit, or sell it without the owner's prior written permission.
The ISEA name, isea.org, and the ISEA logo are ISEA's marks. You may not display or use them in any way without ISEA's prior written permission, which you can request at [email protected].
 

16. Copyright Complaints
ISEA takes others' intellectual property rights seriously and responds to notices under the Digital Millennium Copyright Act. If you believe material on the Site infringes your copyright, send our designated agent a written notice that includes:
1.    your physical or electronic signature;
2.    identification of the copyrighted work you believe is infringed;
3.    identification of the material you believe is infringing, with enough detail for us to find it on the Site;
4.    your name, address, phone number, and email address;
5.    a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; and
6.    a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Repeat infringers. We will end the accounts of repeat infringers in appropriate circumstances.
 

17. Governing Law
You agree that Iowa law governs these Terms and any dispute relating to the Site.
 

18. Entire Agreement
These Terms are the entire agreement between you and ISEA about your use of the Site, and they replace any earlier agreement between you and ISEA on the same subjects. Additional terms may apply when you deal with advertisers, follow links, or use third-party content or services, and when you use features such as event registration, courses, or the ISEA Store.
Your membership in ISEA, NEA, and your local association is governed by those organizations' governing documents, including the ISEA Constitution and Bylaws, and by your enrollment terms, not by these Terms.
